Hi all , just after some advice please, I get pip at the lower rate for the daily living component and the high rate for mobility for my multiple sclerosis, I was awarded an an indefinite award at tribunal years ago , this year I had breast cancer and had a single mastectomy I am currently still having problems with numbness / pain and believe I could now be entitled to the higher rate on the daily living component so I’ve contacted pip and am awaiting new forms to fill in , but now I’m panicking as I’m worried I’ve put my initial claim in danger as on top of everything I cannot face another fight , does anyone know if because they gave me an indefinite award at the tribunal that that is safe even though I have now made them aware of additional problems.. any advice would be much appreciated 

  • Dear Suzanne, please contact your local Citizens Advice/Macmillan caseworker to look at whether you will be entitled to more points and the higher rate. When DWP gets a request for a 'supersession' they will consider the whole of the award which means there is a risk. However if you get advice first you should only proceed if you have clear grounds for the higher rate. Just requesting the form has NOT put your claim in danger. Get advice and only proceed if they feel you have a good case for higher rate. Also they need to consider risk to your lifetime tribunal award against what DWP may consider to be a temporary impact on your health in respect of a higher rate, meaning they may give you a short term award and you will then be reviewed again when that ends.  Good luck x
