Benefits when sick leave ends

I work term time in a school, so I do not work summer holidays and half- term,  but have just learned that my sick leave is continuous,  so that means that they count as time I've been off work sick, even though they aren't working hours!. 

I was diagnosed in April and had a mastectomy which meant I couldn't work Monday - Friday as I run a busy library by myself but i did go into school on the odd Saturday for a few hours. I then had left axilla clearance at the end of May, so again couldn't wor,  but I did some work from home (book ordering and liasing with staff about planning inductions, literacy etc). I presume this doesn't count either,  especially as I was signed off on paper at thr time,  but my head suggested I could work from home.  I had no actual guidance about what I read entitled to from thr school,  but was generally told it would be five months.  

Anyway,  having expected to be paid into November realise that my sick leave is pretty much ended.  Can anyone suggest ther best place to get advice on benefits now?

    Sorry you now got this concern .

    If you ring the 0808 main number for macmillan they have a financial adviser for benefits or you can go online for a checker and calculator .

    This includes PIP and ESA .  At least this gives you a starting point .

    Also are you in Union can they advise ?

    I just really need to know how it works as when I checked the Gov.org website it was very vague and ambiguous. It states that I'm not entitled to it during the holidays:

    'A term-time worker who becomes sick outside of their contract, for example during school holidays, is not entitled to SSP, as they’re not an employee during those weeks.'

    but as I have a permanent contract (not annual etc.) that my entitlement continues through:

    'Where a contract continues between term times, any entitlement to SSP will continue during and after the holiday periods until the earlier of the end of the contract or PIW.'

    I read that as the holidays not counting, but term-time counting until the 5 months were up.

  • Are you public sector?  If so you should get 6 months full and 6 months 1/2 pay.  You need to speak to payroll about your sick entitlement as this will have happened before and will be able to tell you what paid sick leave you have.  Paid dock leave is on a rolling 12 months and is usually allocated on days.  Tell them the days you worked.you automatically get contribution based ESA for 12 months when you claim as you’ve paid NI.  If in union speak to them too

    as you say very ambiguous I was retail

    and If some one was on long term sick 

    we would , for payroll purposes pay holiday . Then revert to Ssp . So one week spring etc . I’m sure you’ll get the answers you need on here

  • It’s service related so 1 year is 1 month paid 1 month 1/2 paid up to max of 6 months paid / 6 months 1/2.  In addition to this you have annual leave and bank holidays which you are entitled to too.  They should know this but remind them.  If you didn’t take all your annual leave for the year because you were sick legally  only allowed to carry forward legal minimum annual leave plus bank holidays (30 days) but many LA allow full leave entitlement plus bank holidays.

    so as an example my leave year is Jan-Dec and I had only taken 5 days when I went off in May do I had 26 days plus 3 bank holidays when I returned In October .  I also had 4 weeks phased return where I worked 2 then 2 etc days a week so as I couldn’t take all my leave in December I carried forward into next leave year 

  • I don't have annual leave to take. It's a weird system where it's part of my hours. Hopefully I'll get something closer to answers tomorrow, but will def. check it.

  • But your pay includes pay for annual leave so you technically do have holidays to take.  A term time employee usually works 38 weeks a year but pay is split over 12 months so you  have a monthly salary.  You are not paid 38/52 though depending on length of service it will be between 80-90% of full time pay to include payment for holidays.  So sick pay entitlement is more complex.

  • Hope it helps.  I found my payroll section manager very knowledgeable on term time employee rights.  No part timer can be treated less favourably than a full time employee. X
