Power of attorney scotland

My doctor doesnt sign the required form and solicitors are so expensive i am quite capable of filling in paper work myself can you another professional person sign this form ty hope its ok to post this

  • Hi again  we are going through this (in Scotland) at the moment but we are getting it done through our solicitors to make sure it’s fine correctly……. but the Government info does says…..

    You can draw up this document yourself, but most people use a solicitor so nothing is missed.

    If you write the document yourself, it's important you refer to guidance to make sure your document gives your attorneys the necessary powers they may need to make decisions on your behalf.

    Read the code of practice for continuing and welfare attorneys. Chapter 2 – Creating a Power of Attorney – takes you through a list of the types of 'powers' you might want to include in the document and other key points to think about.

    There is advice available, for example from the Office of the Public Guardian.

    A solicitor or medical doctor must interview you and sign your document to show you understand the decision you are making”

    …… but this may be more challenging than you think.

  • Hi - you're right, it is expensive.  My PoA was £350 with my solicitor.  Suggest you phone-up the Macmillan helpline to get some specialist advice on this. 

    I was speaking to my oncologist about a template Advanced Care directive the solicitor shared with me (didn't take it forward).  However, as an aside he (onco) advised that many PoA they are given, they are not able to use them.   When you get PoA done with a solicitor, they are not just signing, they write the document to meet your requirements.

  • …… as for someone else signing the form I have no idea but you could put your question to our Ask an Expert section but do allow 3 working days for a reply……. but this may take longer as it’s the Easter Weekend.
