Companies House - late filing penalty

Hey all,

bit of a niche one this but thought I’d ask anyway. 

I was diagnosed and treated for head and neck cancel last year - short version, 6 weeks of Radio and Chemo followed a few months later by a neck dissection and lymph node removal. 

I’m all clear now - but I was pretty out the game for the majority of last year. 

this impacted a few things financially for me - but I have to say most of the companies I spoke to were very understanding and accommodating given my circumstances - except companies house. 

I have a dormant company registered that I keep ‘alive’ for various reasons and due to my diagnosis and treatment last year I was late submitting the annual accounts. 

when I did feel up to doing it, I got the form wrong a couple of times as my cognition still not 100% - but I did manage it in the end. 

however they have levied a £1500 fine against me. 

I kinda assumed they’d be understanding of my situation and waive or materially reduce the penalty on appeal - but no. 

effectively they have said, sooty about your cancer but penalty stands as is. 

I can’t afford it and don’t know what to do next - anyone had similar experience of have any advice?

    Companies House are notorious for refusing appeals against late filing penalties and £ 1500 is the over 6 months old penalty. I think you have 3 choices here:

    * Ignore them - it's a dormant company with no assets so just where are they going to get £1500 from?

    * Have a word with your MP - tell him the circumstances and that if needed you can back up your ill health claim with your diagnosis and treatment plan and ask him to have a word with the Appeals section at Companies House. In reality they are just wasting public money at Companies House following this up.

    * Pay the penalty.

    I think the middle option is worth a go - good luck.

  • Quite agree with Brian, totally typical of any Government Body, send another letter if you wish but CC your MP with it explaining again the situation just as long as you have no Gurantees with the Company then it is dormant
